Terms of Service

These Terms of Service (“Terms”) govern all client interactions with Medical Skin and Laser, including in-clinic treatments, consultations, and online or e-commerce purchases. By booking an appointment, receiving treatment, or making an online purchase, you agree to these Terms, which comply with Australian Consumer Law (ACL).

 

 

1. Appointment Confirmation

Clients may confirm appointments via phone or email.
We send reminders by email, SMS, or phone 24–72 hours before the scheduled appointment.
Clients must respond “Yes” or “No” to confirm or cancel.

  • Credit card details or a reservation fee are required to secure appointments. Card charges apply only if there’s a late cancellation or no-show.

  • Certain treatments require a reservation fee, which will be used as credit for the appointment but is forfeited if canceled late or unattended.

 

 

2. Payment, Processing & Surcharges (Updated October 2025)

Payment is required on the day of service, unless prepaid via Automed, Tyro, or other authorised gateways. We accept EFTPOS and card payments for services provided.

All merchant processing fees, payment-gateway surcharges, and e-commerce transaction costs associated with online pre-payments or in-clinic card transactions are charged to the patient at cost.

This includes the Tyro EFTPOS surcharge for in-clinic transactions and the Automed processing fee for online payments, deposits, or bookings.

These charges are set by third-party providers and disclosed at checkout, terminal display, or on receipts.

All surcharges are calculated exclusive of GST, with GST applied in accordance with Australian taxation law.

Shipping and postage costs for prescribed products, supplements, or skincare are borne by the patient and non-refundable once dispatched.


 

 

3. Cancellation & No-Show Policy

A minimum of 24 hours’ notice is required for cancellations via email or phone.
Cancellations with less than 24 hours’ notice, or non-attendance, incur an $80 fee, charged to the card on file.
Frequent breaches may result in mandatory prepayment for future bookings.

 

 

4. Liability Waiver

All medical and aesthetic procedures carry inherent risks. Clients acknowledge that results vary and agree not to hold Medical Skin and Laser, its staff, or contractors liable for adverse outcomes, except where prohibited by law.
This waiver does not exclude or limit any rights guaranteed under the ACL.

 

 

5. Consultation & Suitability Disclaimer

All treatments are subject to professional consultation, and informed financial consent.
Medical Skin and Laser reserves the right to decline or modify treatment if deemed unsuitable or unsafe for the client’s health.

After 2(two) years of non-attendance, patients may require a new initial consultation to re-establish care.

 

 

6. Privacy & Data Security

All personal and medical information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

7. Package Expiry & Transferability

Treatment packages must be redeemed within 12 months of purchase unless otherwise stated.
Packages are non-transferable unless prior written approval is granted by management.
Note: Gift cards remain valid for a minimum of three years under ACL.

 

 

8. Repeated Cancellations & Account Restrictions

Clients with repeated late cancellations or no-shows may be required to pay their late cancellation fee before they are able to rebook, and/or prepay or pay a deposit for all future bookings.
Persistent breaches may result in restricted or refused future appointments.

 

 

9. Treatment Results & Expectations

While the clinic strives for optimal outcomes, individual responses vary.
Follow-up sessions may be recommended. This will incur additional costs, paid by the patient. There is no “100% guarantee” of any service provided at Medical Skin and Laser.
Medical Skin and Laser provides realistic expectations consistent with ACL prohibitions on false or misleading representations.

 

 

10. Complaints & Dispute Resolution

We encourage clients to raise any concerns promptly with management.
If unresolved, disputes will first proceed to confidential mediation before any formal legal action.
Nothing in this clause restricts statutory rights under the ACL.

 

 

11. Right to Refuse Service

The clinic reserves the right to refuse treatment or terminate a client relationship if:

  • The procedure poses a medical or safety risk;
     

  • The client behaves abusively, disruptively, or breaches these Terms; or
     

  • Continuing service would compromise practitioner or client welfare.
    All decisions comply with anti-discrimination and health-care law.
     

 

 

12. Refund Policy

Medical Skin and Laser does not issue refunds for change of mind on services, treatments, or packages.
Refunds or replacements apply only where goods are faulty, unsafe, or not as described under ACL.
Products must be unused, in original packaging, with proof of purchase.
Reservation fees are non-refundable but may remain as clinic credit at management’s discretion.

 

 

13. Payment Terms

Payment is due on the day of service unless otherwise arranged.
Some services require pre-payment.
We accept EFTPOS, credit card, or approved integrated systems (e.g., Tyro, AutoMed).

 

 

14. Specials, Discounts & Pricing

Specials and discounts are standalone offers and cannot be combined.
Pricing is subject to change without notice.
Clients receive written confirmation or quotes prior to treatment.
Under AHPRA and TGA marketing guidelines, clinics may not advertise S4 (Prescription-Only) medications. Enquire directly with our team for these services.

 

 

15. Minors (Under 18) & Children

For safety and infection control, children and pets are not permitted in treatment rooms.
Clients under 18 require parental or guardian consent and are treated only for medically indicated conditions.
Cosmetic treatments for minors are not performed.

 

 

16. E-Commerce Terms

Returns: No refunds for change of mind. Faulty items will be replaced or refunded under ACL.
Shipping: Orders dispatch within 3 business days via Australia Post. Medical Skin and Laser is not responsible for carrier delays.
Postage & Handling: Non-refundable once processed.

 

 

17. Intellectual Property & Website Use

All website, social media, and marketing content (text, design, images, and media) are the intellectual property of Medical Skin and Laser.
Reproduction, redistribution, or unauthorised commercial use is prohibited without written consent.

 

 

18. Liability & Indemnity

To the extent permitted by law, our liability for any loss or damage is limited to the cost of the relevant service or product.
Clients agree to indemnify Medical Skin and Laser, its directors, and staff against claims arising from misuse, nondisclosure of health information, or failure to follow after-care instructions.

 

 

19. Force Majeure

Medical Skin and Laser shall not be liable for any delay or failure to perform obligations under these Terms due to events beyond reasonable control — including but not limited to natural disasters, pandemics, power or equipment failure, government restrictions, industrial disputes, cyber incidents, or transport disruptions.
This clause applies equally to clients located outside Western Australia, including interstate and online purchasers, and will be governed by the laws of their respective jurisdictions to the extent consistent with this agreement.

 

 

20. Changes to Terms

Medical Skin and Laser may update these Terms periodically to reflect legislative changes, business developments, or service updates.
Notice of changes will be published on our website. Continued engagement constitutes acceptance of updated Terms.

 

 

21. Governing Law & Jurisdiction

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.
For clients outside Western Australia, these Terms remain enforceable to the extent permitted under the consumer protection laws of the relevant state or territory.
Any disputes will be heard in the courts of Western Australia unless otherwise required by applicable interstate law.

Medical Skin and Laser — Fee & Surcharge Schedule Addendum

This Fee & Surcharge Schedule forms part of the Medical Skin and Laser Terms of Service and applies to all payments, online pre-payments, and product purchases. The following charges are transparently disclosed to ensure compliance with Australian Consumer Law and to uphold the Clinic’s commitment to fee transparency.

 

 

1. Payment Platforms

The Clinic accepts the following approved payment methods:

  • Automed (online bookings & pre-payments)
     

  • Tyro EFTPOS (in-clinic card transactions)
     

  • Tyro Online (secure e-commerce gateway)
     

  • Direct Deposit / Bank Transfer (by prior arrangement only)
     

  • Cash Payments (in-clinic only)

 

 

 

2. Merchant & Transaction Surcharges

Automed ecommerce

Processing fee per online transaction

$0.35 AUD flat

Applied automatically at checkout for all Automed online bookings and pre-payments.

 

Tyro Online

Card transaction fee (Visa / MasterCard / Amex / Debit)

As per Tyro’s published transaction rate. Currently 1.7% online via Automed.

 

Displayed on payment terminal and receipt at time of payment. Charged directly to patient at cost.

 

Tyro In-Clinic EFTPOS

Card processing surcharge As per Tyro merchant rate

Varies by card type. Disclosed at terminal prior to authorisation.

 

Direct Deposit

Nil surcharge

$0.00

Must be pre-approved by Clinic management.

 

Cash Payment

Nil surcharge

$0.00

Available for in-person payments only.

 

All surcharges are passed through at cost and non-negotiable, reflecting the direct charges imposed by third-party payment providers.

Express Post

From $13.95

1–3 business days

Recommended for time-sensitive prescriptions or skincare orders.

Signature on Delivery

+ $2.95

Shipping is Quoted at checkout or prior to dispatch.


Postage costs follow Australia Post’s official rate structure and are non-refundable once items are shipped.
 

Packaging and handling are included in the quoted rate.
 

 

 

4. Refunds & Adjustments

Surcharges and postage costs are non-refundable unless required by law.
Any overcharges identified through transaction review will be promptly refunded.
